This presentation will update natural resources law practitioners on two recent developments related to Clean Water Act jurisdiction and permitting requirements: (1) the Trump Administration’s recently proposed waters of the U.S. (“WOTUS”) rule and current status of WOTUS in light of ongoing litigation; and (2) the U.S. Supreme Court’s recent grant of a petition for certiorari addressing the issue of whether groundwater discharges require national pollutant discharge elimination system (“NPDES”) permits. The goal will be to highlight practical implications of these evolving regulatory developments.
