"Navigating the Appeal of an APS Substantiated Finding of Mistreatment of An At-Risk Adult (aka a CAPS Appeal"
 
Your client receives a Notice of Substantiated Finding of Mistreatment of An At-Risk Adult. APS has found the client to have committed exploitation or caretaker neglect or physical abuse or some combination of these harms. The letter states your client has 90 days to appeal the decision. Now what? This presentation will provide an overview of the appeal process and identify key provisions of the Code of Colorado Regulations governing Adult Protective Services and CAPS appeals, important timelines, preparing a Request for State Level Fair Hearing, tips for negotiating with CAMDRS for a stipulated settlement, and if negotiations are unsuccessful, setting the matter for hearing before an ALJ.
