Affirmative defenses in civil cases are not applicable in OSHA cases. However, case law has established those affirmative defenses which are applicable. This program will focus on two of the most common affirmative defenses in OSHA citation proceedings: Supervisor or employee misconduct and multi-employer liability affirmative defenses. The Employer's burden of proof will be discussed along with the prima facie elements of each defense. Focus will be on what case law requires the Employer maintain and produce to establish these affirmative defenses. Other affirmative defenses permitted in OSHA proceedings will be also be discussed as time permits
