"ICWA Issues and the Impact on Family Law Cases in Light of Stockwell"
 
The Indian Child Welfare Act, 25 U.S.C. § 1901, et. seq., is a federal law that was promulgated to protect the best interests of Indian children and to promote the stability and security of Indian tribes and families. This presentation will focus on recent developments within Colorado judicial branch in light of the In re Stockwell case, 446 P.3d 957 (Colo. App. 2019), and the resources that have been developed since. We will specifically focus on the applicability of ICWA within Non-Parent Allocation of Parental Responsibilities Actions. We will start by identifying the initial Inquiry and Notice requirements that must be followed in order to determine if ICWA applies, and then we will further discuss the additional statutory requirements that must be addressed in order to satisfy ICWA before APR can be granted to a non-parent.
