Another Tool for the Toolbox: Supported Decision-Making

Supported Decision-Making (“SDM”) is a voluntary process that enables people with disabilities to maintain decision-making authority over their own lives with the assistance of members of their support community. We will discuss the theory behind SDM and briefly review the expanding legal recognition of SDM in the United States. We will then focus on recent Colorado legislation regarding supported decision-making agreements (“SDMA”) and how they can be used as an alternative to a guardianship or conservatorship, or used concurrently with an existing guardianship or conservatorship in order to allow individuals to have more control over important life decisions. In addition, we will discuss practice tips on how to help clients establish their own SDMAs and additional resources available.
