LEGAL ETHICS: Competence, Confidentiality, and Cybersecurity

Cybersecurity is one of the greatest challenges facing lawyers and law firms today. The current environment poses a host of threats, and the ethics rules now require lawyers to be competent regarding technology and to make “reasonable efforts to prevent the inadvertent or unauthorized disclosure, or unauthorized access to, information relating to the representation of the client.” Lawyers and law firms practicing in the area of financial institutions are among those at highest risk, given the information they have in the representation of their clients. This presentation will address lawyers’ duties to protect against cyber incidents, including specific things that lawyers can do now, and lawyers’ duty to notify after an electronic data breach or cyberattack, based on newly-released ABA Formal Ethics Opinion 483.

Meet Your Faculty
 
Cecil E. Morris, Jr., Esq., is of Counsel with the firm Fairfield and Woods, PC in Denver. Mr. Morris graduated from the New York University School of Law, has been in practice for more than 30 years, and is a member of the California and Colorado Bars. His practice emphasizes complex civil litigation and arbitration, mainly in the areas of securities, business and commercial law.
 
Cecil also has expertise in legal ethics and attorney discipline defense. Among other things, he has been a member of the Standing Committee on the Rules of Professional Conduct of the Colorado Supreme Court since it was established in 2003, and he has been an active member of the Ethics Committee of the Colorado Bar Association for more than 20 years and was Chair of the Committee in 2004-2005. In addition, Cecil served on the Conduct Committee of the United States District Court for the District of Colorado from 2005-2011 and was Chair of the Committee in 2010-2011. Cecil writes and lectures frequently on issues of legal ethics.
