IP Practitioner and the Marketing Department- Trademarks, Advertising, and Promotions

IP practitioners, both in-house and in private practice, are often called upon by the marketing department to help bring their big ideas to life. This presentation will highlight important issues related to trademarks, brands, advertising compliance, endorsements/testimonials, as well as sweepstakes/ contests, and social media promotions. We will include some real-life examples of what to do and what to avoid.
 
 
About the presenters:
 
Ashley Krause is Managing Counsel at RE/MAX, LLC, a global real estate brokerage franchisor with a presence in over 110 countries and territories. She oversees the worldwide intellectual property protection and enforcement efforts for the RE/MAX family of brands. She also advises the RE/MAX marketing, social media and communications teams on advertising issues. Ashley is an active member of the International Trademark Association, serving currently on INTA’s In-House Practitioner’s Committee and previously on the Enforcement Committee and the Famous and Well-Known Marks Committee. Prior to joining RE/MAX, she was a shareholder at Brownstein Hyatt Farber Schreck, where she advised a wide range of clients on brand protection, registration and enforcement matters.
Charlene Krogh is Chair of Dorsey’s top-ranked Trademark, Copyright and Advertising practice group. Charlene serves as intellectual property counsel for small and large businesses in a large variety of industries, including consumer products, cosmetics, financial services, telecommunications, software, and medical devices. Charlene has extensive experience in all stages of the brand management process, including trademark and copyright selection, clearance, prosecution, maintenance, enforcement, and exploitation. This work includes representation of clients in opposition and cancellation proceedings before the Trademark Trial and Appeal Board and assistance with take down requests related to online infringement, as well as prosecution of UDRP proceedings. Charlene also has significant experience in transactions involving intellectual property, including due diligence, negotiation of agreements, and assistance with the transfer of intellectual property rights and recordation of security interests related to corporate transactions and asset purchase and sale agreements. Charlene is the co-manager of Dorsey’s IP Blog, TheTMCA.com, named one of the “Top 50” law blogs by the ABA Journal in 2017. Charlene is also the Pro Bono Coordinator for the Denver office of Dorsey & Whitney and authors Chapter 29 of The Practitioner’s Guide to Colorado Business Organizations.
