Program Description:
Join Sarah Mercer and Jack Hobaugh for a behind-the-scenes conversation about SB 24-205 – the Colorado Artificial Intelligence Act (“Act”). In this discussion, we’ll hear from a panelist who was present during the legislative process, offering unique insights into how the Act was developed. The panel will break down the key components of the Act, including essential definitions, the responsibilities of AI developers and deployers, compliance with AI algorithmic bias and consequential decision-making, and other important provisions. We’ll also explore the potential enforcement of the Act by the Attorney General. Additionally, the panel will provide an update on the AI Impact Task Force (HB 24-1468), which is working to refine the Act ahead of its official rollout in February 2026, including what changes—if any—might be on the horizon for SB 24-205. Although the launch date may feel distant, preparation for the Act should begin now—less
than a year remains.
Speaker Bios:
Jack Hobaugh, a shareholder at Brownstein Hyatt Farber Schreck, specializes in AI, cybersecurity, and privacy law. With a professional background as a cybersecurity expert, he holds a CISSP certification and serves as co-chair of the IAPP KnowledgeNet Denver chapter. Drawing on his extensive experience in global software, database, and network engineering, Jack integrates technical expertise with his legal practice. During his
master's in computer science, he first programmed in LISP, an AI language, back in 1989. At the time, he was skeptical when his professor predicted that AI would soon take over programming jobs. After an 18-year career as a software engineer, Jack's initial doubts have since been dispelled by recent advancements in the field. Jack is the co-author of four books on cybersecurity law, co-developed a law school course on the subject, and is a frequent guest lecturer at McGeorge School of Law.
