"Political Speech in the Workplace: But what about my (sometimes nonexistent) First Amendment rights?” 
 
Employers and employees often navigate through complex workplace issues involving the freedom of speech, political activities, and talks of unionization. Indeed, these complexities arise based on whether the employer is public or private; the topic of the speech; and whether the protected activity occurred at, or outside, the employer’s office. Whether such speech, activities, or conduct is protected turn on several different legal concepts. Despite an employee’s temptation to cite the First Amendment in an effort to protect their job, most times, the First Amendment simply does not apply -- even in an election year as polarizing as this past one. Still, both federal and Colorado laws protect a significant amount of speech and conduct in the workplace. Thus, this presentation will help employers and employees understand the contours of protectable speech in the workplace. First, we will discuss how employee speech may be protected by Section 7 of the National Labor Relations Act as well as relevant Colorado law. We will also discuss when speech may become unprotected. The presentation should leave attendees with the basics for assessing the issues of political speech in the workplace.
