Employee misclassification continues to be a hot topic because the law is in flux. The U.S. Department of Labor just repealed a Trump-era rule for determining when a worker is an independent contractor, while California, Colorado, and other states set their own courses, particularly for “gig workers.” Meanwhile, Congress is considering adding protections for independent contractors for the purposes of federal labor law. This presentation will address statutory and common law tests for independent contractors, how the tests are evolving, and their significance for employers and workers alike.
